CMS Announces No Change in Dates for HIPAA 5010 and ICD-10 Migrations

On Thursday, March 5, 2009, Don Johnson, Acting Director, Office of Legislation of the Centers for Medicare & Medicaid Services (CMS), made it official by notifying Congress that "in accordance with the White House Chief of Staff's memorandum of January 20, 2009 entitled 'Regulatory Review,' a determination has been made that the effective date will not be extended and the comment period will not be reopened for either HIPAA 5010 or ICD-10."
The policies and regulations specified in the Modifications to HIPAA Electronic Transaction Standards Final Rule which adopts ASC X12 Version 5010 replacing 4010A1 and NCPDP Versions D.0, 3.0, and 5.1 standards went into effect March 17, 2009. Compliance with these standards is mandatory by January 1, 2012. A new transaction, the NCPDP 3.0 Medicaid pharmacy subrogation transaction standard, is also adopted with an effective date of January 1, 2010, and a mandatory compliance date of January 1, 2013.
The policies in the HIPAA Administrative Simplification: Modifications to Medical Data Code Set Standards to Adopt ICD-10-CM and ICD-10-PCS are also effective as of March 17, 2009. The compliance date for this regulation is October 1, 2013.
